411 Labs, Inc has certified with the EU-U.S. Privacy Shield with respect to the personal data we receive and process on behalf of our clients.

The Privacy Policy posted on this Site was updated on or about March 30, 2018.
This policy covers how 411Labs treats Personally Identifiable Information (“PII”) that 411Labs collects and receives regarding your use of our corporate website (https://411Labs.com) and your use of our online product, InSite, including information related to your past use of 411Labs products and services. Where there is a distinction in this Policy between how information is treated between the 411 Labs corporate website (“411 Website”) and our InSite offering, we will make the distinction and differences clear by having different sections for each. 411 Labs, Inc. and its affiliated entities are collectively referred to in this Privacy Policy as “411Labs,” “we,” or “us.” Please read this document carefully.

Under the EU General Data Protection Regulation (GDPR) citizen’s of the European Union (EU) have certain rights regarding their data that is collected and stored on our systems and websites, regardless of the jurisdiction where that data is held:
- You have the right to Access and/or obtain any data concerning you in an electronic format.
- You have the right to be forgotten on our systems.
- You have the right to request the erasure of your personal data.
- You have the right to consent or object to the use of your personal data in marketing.
411Labs fully adheres to these rights under the GDPR. To exercise these rights please submit a request to our privacy officer at privacy@411Labs.com. In addition, if you feel that we have not addressed your concerns regarding your data, you have the right to file a complaint under the EU US Privacy Shield framework. Please see the previous section for links to initiate that process.
4.Scope of this Privacy Policy
411Labs Corporate Websites (our public websites):
This Privacy Policy applies only to PII collected by 411Labs through our corporate website (411 Site) or software or mobile app installation or use or visitation to any other 411Labs corporate websites, or where this Privacy Policy is posted (the “Site”) and does not apply to any other information collected by 411Labs through other means. If you have other agreements with 411Labs governing 411Labs products and services, then those agreements control with regard to the subject matter of those agreements. Further, our Privacy Policy does not cover the activities of third parties.

In the case of the InSite service, our Privacy Policy extends to cover the activities of third parties.

6.The Information We Collect
The 411Labs Public Websites:
411Labs collects certain personal information when you register on 411Labs.com, or request information. In registering with 411Labs or requesting information, you may provide us with a password, your real name, industry, organization name, job role, and contact information, such as e-mail address, phone number, and shipping address. We may also collect your product registration information, product interest information, transaction information, demographic information. In addition, for certain licensees or agreements, 411Labs may require additional information, such as date of birth or other verification information. We may collect payment information such as your credit card number and billing address if you purchase or license products and services from us. If you connect with 411Labs accounts on third party social networking sites, we may also collect information about your social networking accounts, for example, your name, user name or handle, public profile, and email address. We may also combine information you provide with data we collect automatically (as further described below) and with data we receive from third parties.
Whenever you visit the 411Labs website 411Labs also receives and records information on our server logs from your browser, including your computer’s or mobile device’s operating system type and version, browser type and language, your Internet Protocol (IP) address, and geographic areas derived from your IP address, 411Labs cookie information, file information, time stamped logs regarding access times and duration of visits, the websites you visited before coming to 411Labs websites, and other usage data relating to your activities on our Sites, including the pages you request. We may relate this information to the PII you provide for purposes described in this Privacy Policy.
If, in the future, 411Labs develops and releases a mobile app, we may also automatically collect information about your device and about your usage of and activity on our mobile apps. For example, we may collect your device’s mobile operating system type and version, browser type, device type, geolocation data, Wi-Fi networking connection data, Internet Protocol (IP) address, device identifiers, time stamped logs regarding access times and duration of visits, and other information.
We may pass your personal data to certain third parties (onward transfers), including analytics companies, advertisers and ad networks. Those third parties may also automatically collect information about you through our Sites, using cookies, Web beacons, and device identifiers, including personally identifiable information about your online activities over time and across different websites, devices, online channels and applications when you use our Sites.
In any case, where we have received your personal information under Privacy Shield and subsequently transfer it to a third party acting as an agent on our behalf (onward transfer), we remain liable under the Privacy Shield Principles. The third parties we work with must also abide by the Privacy Shield Principles and their compliance is incorporated into our contracts with them. We remain liable should your personal information be processed by our agent in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.
The InSite Service:
411Labs collects certain personal information when you register as a user of the InSite service. In registering as an InSite user, you may provide us with a password, your real name, organization name, job role, and contact information, such as e-mail address. In addition, for certain licensees or agreements, 411Labs may require additional information, such as date of birth or other verification information. We may collect payment information such as your credit card number and billing address if you purchase or license products and services from us. As a user of InSite we do not combine your InSite information with other data we collect automatically (as further described below) nor with data we receive from third parties.
Whenever you log on to your InSite service website, 411Labs also receives and records information on our server logs from your browser, specifically your Internet Protocol (IP) address, and geographic areas derived from your IP address.
411Labs does not currently have an InSite service mobile app.
As an InSite service user, we do not pass your personal data to any third parties (onward transfers).
Any third parties we work with on the InSite service must also abide by the Privacy Shield Principles and their compliance is incorporated into our contracts with them.
7.Information we may hold as a GDPR Data Processor within InSite
The InSite Service:
411 Labs meets the definition of a Data Processor under the EU’s GDPR. As such we may hold PII extracted from your Jive site – specifically regarding data within Jive user profiles. The users whose Jive data we hold maintain their rights under the GDPR. Specifically:
- They have the right to Access and/or obtain any data concerning them in an electronic format.
- They have the right to be forgotten on our systems.
- They have the right to request the erasure of their personal data.
- They have the right to consent or object to the use of their personal data in marketing.
We will comply with any request from our customer’s authorized representative to remove or anonymize the personal data of any user whose data we store in the InSite databases. If that data is altered or deleted on the customer’s Jive site, those changes will be reflected in the data we hold within 24 hours. If it is not, we will remove or anonymize it manually on our databases within 24 hours of receiving such a request in writing or via email from an authorized representative of our InSite customer.

In addition, if a Jive use whose data we hold is not satisfied with our response to their request to remove or anonymize their data, they may file a complaint under the EU US Privacy Shield framework. Please see the Privacy Shield section for instructions on initiating a complaint.
Other specifics governing the transfer and handling of data under GDPR may be referenced in a Data Protection Agreement (DPA) executed by 411 Labs and your company. Should there be a conflict between this Privacy Policy and the terms of the DPA, the terms in the DPA shall govern.
8.How We Use Your Personal Information
411 Labs Corporate Websites:
We use PII collected through our Sites for purposes described in this Privacy Policy and as disclosed to you in connection with our Sites. For example, we may use your information to:
- Provide and deliver products or services you’ve requested, including software updates;
- Operate and improve our internal operations, systems, products, and services;
- Understand you and your preferences to enhance your experience;
- Respond to your comments and questions and provide customer service;
- Send you service-related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
- Communicate with you and your referrals about promotions, upcoming events, and news about products and services offered by 411Labs and our selected partners;
- Link or combine information about you with other personal information we get from third parties, to help understand your needs and provide you with better and more personalized service;
- Enforce our terms and conditions or protect our business, partners, or users;
- Protect against, investigate, and deter fraudulent, unauthorized, or illegal activity.
The InSite Service:
Other than the information we collect from you as a user of the InSite service reference in the previous section, we do not collect or use any other PII from you. We may use that information in order to:
- Provide and deliver products or services you’ve requested, including software updates;
- Operate and improve our internal operations, systems, products, and services;
- Understand you and your preferences to enhance your experience;
- Respond to your comments and questions and provide customer service;
- Send you service-related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
- Protect against, investigate, and deter fraudulent, unauthorized, or illegal activity.
9.How We May Share or Disclose Your Personal Information
411 Labs Corporate Websites:
411Labs does not rent, sell, or share PII about you with other people or nonaffiliated companies, except under the following circumstances:
- When we have your permission including when you choose to share information using 411Labs Public or post to our blogs.
- We may provide PII to trusted partners who work on behalf of or with 411Labs to provide us with services. For example, these companies may use your PII to help 411Labs communicate with you about offers from 411Labs and our marketing partners.
- We may share some or all of your information with our current or future “affiliates” (which means a parent company, any subsidiaries, joint ventures, or other companies under common control), in which case we will require our affiliates to honor this Privacy Policy.
- We may disclose PII to comply with laws or in response to legal process, for example, in response to a court order or a subpoena. We also may disclose PII in response to a law enforcement agency’s request, or where we believe it is necessary to investigate, verify, prevent, enforce compliance with, or take action regarding: illegal or suspected illegal activities; suspected fraud; situations involving potential threats to the physical safety of any person; protection of the rights and property of 411Labs, our agents, customers, or others; or violations or suspected violations of our agreements, policies, Terms of Service or Master Subscription Agreement (MSA); or as otherwise required or permitted by law or consistent with legal requirements. We reserve the right to transfer or disclose PII in our system in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or other proceeding involving sale, transfer, divestiture or assignment of all or a portion of our business or assets to a different entity.
- Finally, we may also share aggregated, anonymized or statistical information about you, including demographics data, with others for a variety of purposes, including for their own uses, for example, for improving their products and services for 411Labs and others.
The InSite Service:
411Labs does not rent, sell, or share PII about you, as an InSite user under any circumstances, except as noted below:
- We may disclose PII to comply with laws or in response to legal process, for example, in response to a court order or a subpoena. 10.What Cookies and Web Beacons Are and How We and Others Use Them
The 411 Labs Corporate Websites:
Our Site may use various software technologies including “cookies,” “web beacons” and “pixel tags.” “Cookies” are small text files that we and others may place in visitors’ computer browsers to store their preferences. Cookies themselves do not contain any PII. “Web beacons” or “Pixel tags” are small pieces of code placed on a web page or within the body of an email to monitor the behavior and collect data about the visitors viewing a web page or viewing or opening an email. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page. We may use web beacons on our Site from time to time for this and advertising purposes.
From time to time, we partner with third parties who may place cookies on your browser when you visit our Sites, may send their own cookies to your cookie file, and may use those cookies to track and collect information about you and your online activities over time and across different websites, devices, and applications and to provide targeted advertising based on your interests and previous browsing history.
Certain third party ad networks may automatically collect information about your visits to our Sites and other websites, such as your IP address, your Internet service provider, and the browser you use to visit our Sites. They do this using cookies, web beacons or other technologies. The InSite Service:
The InSite service does not use various software tracking technologies including “web beacons” and “pixel tags.” The InSite service does use a single Cookie to track a Session ID while you are logged in to the service. “Cookies” are small text files that we may place in in your computer browser to store your user preferences. Cookies themselves do not contain any PII.
11.What Internet Protocol Addresses Are
The 411 Labs Corporate Websites:
An Internet protocol (“IP”) address is the unique number assigned to your server or Internet Service Provider (“ISP”). 411Labs may track such IP addresses for system administration, to report aggregate information, site tracking, to prevent our servers from being abused and for other uses described in this Privacy Policy.
The InSite Service:
An Internet protocol (“IP”) address is the unique number assigned to your server or Internet Service Provider (“ISP”). 411Labs may track such IP addresses for system administration, to grant you access to your InSite instance, to report aggregate information, to prevent our servers from being abused.
12.Collection of Information by Third-Party Sites and Sponsors
The 411 Labs Corporate Websites:
Our Site contains third party sites linked from our Site to other Web sites, including those of our partners and sponsors, whose information practices may be different from ours. Sometimes these third party websites might conduct contests or sweepstakes and other activities that are promoted on our Site and visitors are directed away from our Site in order to participate in such activities.
You may also connect to third party services to share your information on and through their social media platforms, websites, applications, and services through “plug-ins,” widgets, buttons, and other third party features on and connected with our Sites.
This Privacy Policy does not apply to the activities of these third parties when they are collecting or using data for their own purpose or on behalf of others. Please consult the respective privacy policies and statements of such third parties for more information.
The InSite Service:
The InSite service links to your Jive instance in order to pull the data from your Jive instance into our servers in order to provide you with the Jive analytics you need from InSite and to inject Campaigns or Community Cleanup functions into your Jive instance. In addition we may link to other sites for the purpose of those sites hosting certain assets utilized by the InSite service – for example Google hosts one of the fonts used in InSite.
13.How We Secure and Store Your Information
The 411 Labs Corporate Websites:
We have put in place reasonable and appropriate physical, electronic, and managerial procedures in an effort to help safeguard information we collect through our Sites. However, you should know that no company, including 411Labs, can fully eliminate security risks associated with PII. To help protect yourself, please use a strong password, do not use the same passwords to access your 411Labs accounts that you use with other accounts or services, and protect your user names and passwords to help prevent others from accessing your accounts and services.
411Labs is a global company with affiliates, varied business processes, management structures and technical systems that cross borders. Information collected by 411Labs or on our behalf may be stored on your computers, on your mobile devices, or on our servers, and may be transferred to, accessed from, or stored and processed in, the United States and other countries including but not limited to Ireland, England, France, Germany, Australia, Singapore, Japan, and China, and any other country where 411Labs or its service providers maintain facilities or support centers (a list of 411Labs offices can be found here: https://www.411labs.com/about_us), including jurisdictions that may not have data privacy laws that provide protections equivalent to those provided in your home country. However, we will protect all personal information we obtain in accordance with this Privacy Policy and take reasonable steps to ensure that it is treated lawfully. We encourage you to review their privacy policies to understand how they user your information. Because your posts and information shared through 411Labs.com are public and can be seen by others, we caution all users to consider what they post and share online and not to disclose any PII as part of their posts, even if requested to do so by other posters. 411Labs will not be responsible in the event that you disclose PII in your posts, through our public services or during any other communication with other site users.
The InSite Service:
We offer you the ability to post information and exchange ideas through our InSite customer support system (CSS). While our CSS is hosted by a third-party, that entity is also certified under the EU US Privacy Shield Framework. Certain information within our CSS may be made available to other InSite users in order to improve our customer support for InSite. 411Labs will not be responsible in the event that you disclose PII in your posts, through our CSS or during any other communication with other InSite users or members of our support team.
15.The Options We Give You For Limiting the Use and Disclosure of; and How Can You Correct or Review Your Personal Information

16.Questions and Complaints
If you believe 411Labs maintains your personal data in one of the services within the scope of our Privacy Shield certification, you may direct any inquiries or complaints concerning our Privacy Shield compliance to privacy@411Labs.com. 411Labs will respond within 45 days. If we fail to respond within that time, or if our response does not address your concern, you may contact JAMS, which provides an independent third-party dispute resolution body based in the United States, at https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim. JAMS has committed to respond to complaints and to provide appropriate recourse at no cost to you. If neither 411Labs nor JAMS resolves your complaint, you have the possibility to engage in binding arbitration through the Privacy Shield Arbitration Panel (https://www.privacyshield.gov/article?id=ANNEX-I-introduction).
